1. Acceptance of Terms

By visiting our website, creating an account, or purchasing a subscription plan on downtime.watch, you engage in our "Service" and agree to be bound by the following Terms & Conditions ("Terms"), including those additional terms, conditions, and policies referenced herein or available via hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.

2. Description of SaaS Services

downtime.watch provides digital cloud-based monitoring solutions, including website uptime monitoring, API assertion testing, SSL certificate expiration tracking, automated incident recovery workflows, and hosted public/private status pages.

By adding targets to your downtime.watch dashboard, you grant our distributed probe servers authorization to make periodic automated network requests (such as HTTP/HTTPS GET, POST, HEAD, DNS, and TLS handshakes) against your designated domains and IP addresses.

3. Account Registration & Security

To access certain features of the Service, you must register for an account. You agree to provide true, accurate, current, and complete information during registration. You are responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify us immediately at support@downtime.watch upon becoming aware of any unauthorized breach of security.

4. Acceptable Use Policy

You agree not to use the Service:

• To monitor, probe, or conduct denial-of-service attempts against servers or endpoints you do not own or do not have explicit authorization to monitor.
• For any unlawful purpose or to solicit others to perform unlawful acts.
• To transmit any malware, worms, trojans, or malicious code designed to harm or disrupt the integrity of third-party networks.
• To harvest or collect personal data of other platform users without consent.

5. Free Trial, Prepaid Fixed-Term Plans & Billing (No Recurring Auto-Debit)

Every new registration includes a 7-Day All-Access Free Trial with complete platform capabilities and multi-region monitoring nodes enabled, without requiring credit card details.

Following the trial, downtime.watch offers prepaid fixed-term plans (Starter, Pro, Agency, Enterprise) available in 1-Month (30 Days), 6-Months (180 Days), and 12-Months (365 Days / 1 Year) durations.

No Automatic Recurring Debits: All payments on downtime.watch are one-time upfront prepaid term charges. We do not register automatic recurring bank mandates or auto-debit customer payment methods. When your prepaid plan duration concludes, you maintain full control to manually purchase a renewal or extend your plan.

All payments are processed securely through certified third-party payment gateways.

6. Plan Termination & No-Refund Policy

As downtime.watch is an instant-access digital SaaS platform with dedicated multi-region probe server infrastructure allocated immediately upon purchase, all one-time prepaid plan purchases (1-Month, 6-Months, 12-Months) are strictly non-refundable.

You retain uninterrupted full access to all your monitoring targets, alert integrations, and status pages for the entire duration of your purchased prepaid term. Please review our detailed Return & Refund Policy and Cancellation Policy.

7. Limitation of Liability & Service Disclaimer

While we strive for 99.99% monitoring reliability across multiple global regions, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. downtime.watch shall not be held liable for any indirect, incidental, punitive, or consequential damages resulting from downtime of your monitored external endpoints, internet network latency, third-party webhook failure, or alert delivery delays by telecommunication or email providers.

8. Modifications to Service and Pricing

Prices for our products are subject to change upon 30 days notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) with prior notification to registered users.

9. Governing Law & Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the applicable laws of India, subject to the exclusive jurisdiction of the competent courts in India.
